Eve Carson Murder Suspect in Federal Court on Carjacking Charges, Faces Death Penalty

Tuesday, December 02, 2008

GREENSBORO, N.C.  —  One of two men accused in the death of the University of North Carolina at Chapel Hill student body president made his first appearance in federal court and faces execution if he is convicted.

Demario Atwater appeared Tuesday in U.S. District Court in Greensboro on several charges, including carjacking resulting in death. Federal prosecutors are seeking a death sentence.

State prosecutors are also seeking the death penalty against Atwater. The 22-year-old is facing state murder and kidnapping charges in Orange County, though a capital murder case there hasn't resulted in an execution in 60 years.

Co-defendant Laurence Lovette isn't eligible for the death penalty because he was 17 at the time of Eve Carson's death.

The 22-year-old Carson was found fatally shot on street not far from campus in March. She was from Athens, Ga.
